Terms of Service

1. The platform

OwnAm Mortgage Quest is an educational and readiness platform. We are not a bank, a primary mortgage institution, the Federal Mortgage Bank of Nigeria, or a registered investment scheme. We do not guarantee mortgage approval. Outside of OwnAm Safe Pay (section 6), we do not take custody of funds.

2. Eligibility and your account

You must be at least 18 years old and legally capable of entering a binding contract to use this platform. You must provide accurate information and keep your login credentials confidential. Misrepresentation of income, employment, or NHF status may result in suspension and removal of your Quest ID and Mortgage Access Passport. You are responsible for all activity that occurs under your account.

3. Mortgage Readiness Score

Your score is computed from self-reported data plus documents verified by our team. It is an indicative readiness estimate, not a credit decision. Partners make their own decisions independently.

4. Payments

Registration, Premium, Passport, Premium Ownership, and Diaspora Premium fees are processed via Paystack, our licensed payment processor. We do not store your card details. Tier fees are non-refundable once the relevant service has been issued, except where a refund is required by applicable law.

5. Points, badges, and leaderboard

Points, badges, and leaderboard rankings are engagement features only. They have no monetary value, are not redeemable, and may be adjusted or reset where awarded in error or through misuse. Leaderboard visibility is opt-in and displays a masked version of your name.

6. OwnAm Safe Pay (escrow)

Safe Pay holds a buyer's payment until the buyer confirms delivery, after which net funds (less platform commission) are settled to the merchant's verified bank account. By using Safe Pay you agree that:

• For each completed escrow transaction, OwnAm charges a 1.5% platform commission fee deducted directly from the seller's settlement payout upon confirmed delivery. Buyers incur no escrow platform fee.
• Funds are held solely to complete the specific transaction and are released on buyer confirmation, refunded on merchant cancellation, or resolved through the dispute process.
• Merchants must complete identity and bank-account verification before receiving settlements, and warrant that goods or services offered are lawful and accurately described.
• Either party may raise a dispute before release; OwnAm will review the transaction record and evidence provided and may release, refund, or split the held amount at its reasonable discretion. Our dispute decision is final within the platform, without prejudice to your legal rights.
• OwnAm is not a party to the underlying sale and is not responsible for the quality, safety, or legality of items transacted.

7. Partner sharing

Your data is shared with partners only with your explicit consent and only for the purpose of evaluating you for a mortgage product. You may withdraw consent at any time from your dashboard, as described in our Privacy Policy.

8. Data protection

We process personal data in accordance with the Nigeria Data Protection Act (NDPA) 2023 and the directives of the Nigeria Data Protection Commission (NDPC). Our Privacy Policy explains what we collect, why, your rights (access, rectification, erasure, objection, portability), and how to exercise them. Cookie preferences can be managed through the in-app consent banner.

9. Acceptable use

You agree not to:

• submit false documents or impersonate another person;
• use Safe Pay for unlawful goods, money laundering, or fraud;
• probe, scrape, disrupt, or attempt to gain unauthorised access to the platform or other users' data; or
• use the platform in breach of any applicable law.

10. Suspension and termination

We may suspend or close accounts that breach these terms, with notice where practicable. You may close your account at any time by contacting us; closure does not affect completed transactions or fees already earned, and we will handle your data in line with the Privacy Policy and our legal retention obligations.

11. Disclaimer and liability

OwnAm is not a financial institution. Nothing on this platform constitutes financial or legal advice — consult a licensed professional before signing mortgage documents. The platform is provided "as is"; to the maximum extent permitted by law, OwnAm's total liability to you for any claim arising from the platform is limited to the fees you paid to OwnAm in the 12 months before the claim. Nothing in these terms excludes liability that cannot be excluded under Nigerian law.

12. Changes to these terms

We may update these terms from time to time. Material changes will be announced on the platform or by email, with the effective date shown above. Continued use after the effective date constitutes acceptance.

13. Governing law

These terms are governed by the laws of the Federal Republic of Nigeria, and the courts of Abuja (FCT) have jurisdiction over any disputes.
